Can I hold a fireworks display in my backyard?

Displays can only be held with a Pyrotechnicians Licence or  Fireworks (Single Use) Licence issued by WorkCover NSW.

People buying and using fireworks without a WorkCover licence risk Police and WorkCover penalty notices with on-the-spot fines of up to $1000. In addition, the courts can impose substantial penalties including up to $27,500 for the illegal sale of fireworks or up to 12 months jail, and fines up to $27,500 for using fireworks without a permit.

People intending to use fireworks illegally should also be aware that they will be held personally responsible for any injuries of damages caused, and as there is no insurance coverage, they could be liable for huge costs.

Should you be the holder of a Workcover Pyrotechnicians Licence, an authorised display may only be held where a  “legitimate reason” is demonstrated such as:

  • Organised public displays
    • A community event organised by a community or private organisation e.g. shows, fetes, carnivals and cultural, religious or sporting events.  A community event is any event that is open to the public whether or not for a fee
  • Theatrical display
    • Film and television special effects
    • Indoor or outdoor theatrical events e.g. concerts and performing arts special effects
  • Technical, non display purposes
    • Industrial and agricultural purposes e.g. chimney testing and bird disturbing devices

Fireworks can not be used at a private function.
