Are there any interim arrangements for consultation to be implemented under the new legislation?

Consultation arrangements must be implemented within 12 months of the commencement of Section 13 of the OHS Act 2000.  The Act commenced on 1 September 2001.

Committees formed under the old Act can be (but do not have to be) retained for the remainder of their term.  Replacement OHS consultation arrangements must be implemented within three months of the end of terms of office of the members of the committee, or within two years, whichever occurs first.

Any training that was undertaken as required under previous legislation is recognised as meeting the requirements of new legislation.
