Who can apply for a private ruling?
Employers or their internal delegates can apply for a private ruling. Employers may seek assistance from external parties in the preparation of their application. Employers must sign the application prior to lodgement with the Worker Status Rulings branch.

Why do I need to complete the private ruling application form?
The information you provide with your private ruling application is designed to assist WorkCover make a decision regarding the worker status of a person(s) or entity. This information also assists you in declaring correct wages for the calculation of your workers compensation premium.

What sort of documents should I attach to my application?
You should include items such as but not limited to:

  • invoices
  • quotes for jobs
  • certificate of currency (if appropriate)
  • subcontractor's statements
  • registration of the business name
  • ABN and GST details
  • Trade Licence details
  • advertisments, business cards and the like.

You should attach as much information as you have available to allow WorkCover to make an accurate decision.

What happens if I'm not satisfied with the private ruling decision?
You have the right to review our decision and discuss the reasons that you do not agree with us. WorkCover has the ability to review the decision if you find that the information provided to us at the time of application was not correct or incomplete.

If you are able to submit additional information that may affect our decision, you may do so in this review. A review will not be undertaken if you cannot provide further relevant facts and evidence.

When do I need to lodge a separate application form?
The private ruling application is designed for person(s) where the same employment situation exists. Where there is a variance such as one person has an ABN and the other does not, you will need to lodge a separate application form for each of these cases.
