The transport and storage industry includes the transportation of freight by road, bus transportation, taxi and hire cars. It also includes toll, bridge and road operation; port and harbour services; and water and air transport.

Long Distance Truck Driver Fatigue Regulation 2005

The Occupational Health and Safety Amendment (Long Distance Truck Driver Fatigue) Regulation 2005, took effect on 1 March 2006. It is now known as Occupational Health and Safety Regulation 2001, Part 4.5 Long distance truck driver fatigue. The Regulation applies to heavy trucks with a GVM of 4.5 tonnes or more transport freight (either single or in a series of trips) greater that 500kms.

The Regulation will require employers of drivers and head carriers, undertaking this type of work, to ensure that the risk of harm arising from truck driver fatigue is either eliminated or appropriately managed. They will also need to develop and implement Driver Fatigue Management Plans (DFMPs) in consultation with their affected employees/drivers.

Consignors or consignees will have legal responsibilities if they have 200 or more employees and carry on a business of which a substantial part is a prescribed business, and falls within at least one of the following industries: agriculture, forestry and fishing, accommodation, cafes and restaurants, mining, transport and storage, manufacturing, communication services, construction, property and business services, wholesale trade, cultural and recreational services, retail trade.

With these developments in mind businesses should be familiarising themselves with the requirements of the Regulation and appropriately preparing for the implementation date.

 WorkCover is committed to working in partnership with industry, delivering information seminars to a variety of stakeholder groups. There will be a continued focus on education and information to ensure the Regulation successfully implemented. Planning has commenced to undertake a compliance verification program due in August 2006.

WorkCover’s Assistance Service (13 10 50) will be available to provide advice and assistance to industry and answer questions directly linked to the Regulation's implementation.

WorkCover has been working with unions, industry associations and employer groups to develop a range of practical guidance material to ensure that stakeholders understand the new requirements and how to apply them.
