The responsibilities of workers will remain unchanged in the new Scheme arrangements. Workers will still be required to:
- tell their employer of any injury or illness immediately
- see their doctor to arrange treatment and get a WorkCover medical certificate to give to their employer
- cooperate in plans for their return to work
- keep in touch with their employer regularly
- return to work as soon as possible in consultation with their doctor
- keep copies of all paperwork
- comply with your injury management and return to work plans
- notify the insurer if any of their employment circumstances change.
It is anticipated that improved Agent performance will result in better communication with workers and improved outcomes.
The responsibilities of employers will also remain unchanged in the new Scheme management arrangements, although it is anticipated that Agents will provide greater assistance to ensure that employers meet their obligations regarding the provision of suitable duties to injured workers.
Employers recognise the benefit of getting injured workers back to work and should assist in this process by:
- notifying their insurer within 48 hours of being notified of a workplace injury
- consulting with the injured worker, their nominated treating doctor and the insurer about the injured worker's return to work plan
- organising suitable (alternate) duties for the injured worker while they are recovering from their injury
- keeping in touch with the injured worker until they recover from their injury and return to their normal duties.
To stabilise the market and increase competition during the first 12 months of operations, a proportion of existing policies and claims will be moved to new Agents.
Existing policies that are selected for transfer will be chosen at random and will only move to different agents on renewal.
Claims selected for transfer will consist of claims that are older than 18 months and have been identified as benefiting from management by an new Agent.
