Time limits for claiming

A claim for workers compensation should be made as soon as possible in order to allow immediate support to the worker.

A claim should be made within a maximum of six months of the date of injury or accident. 

However, a claim can be made for up to 3 years, if the claim was not made earlier due to some reasonable cause, including  absence from the State or mistake.

If a claim relates to an injury resulting in death or serious permanent impairment of the worker, the claim may still be made beyond the of the 3 year period, if there is a reasonable cause for the delay.  

If a period greater than three years has elapsed since the incident then a claim  may still be made with approval from us.

There are special arrangements for cases where a worker is not aware of the injury at the time of the incident.
